General terms and conditions

I. SCOPE

  1. Berg- und Schilift Schwaz-Pill GmbH (hereinafter referred to as “KellerjochBahn”) provides its services to its customers on the basis of these General Terms and Conditions (hereinafter referred to as “GTC”).
  2. The content of the current version of the GTC (which can be accessed on the Internet, displayed in the cash desk area or given to the customer on request) is agreed upon with the purchase of the ticket as part of the contractual relationship between KellerjochBahn and the customer.
  3. The KellerjochBahn is a member of the ticket associations Freizeitticket Tirol, Snow Card Tirol and Skartl. If the customer purchases a ticket for the use of facilities of several companies, the KellerjochBahn acts only as their representative for the other companies. The services that can be used with such a ticket are provided by legally independent companies. The company in whose (ski) area an accident occurred is therefore always obliged to provide the individual services and to cover the consequences of any accidents; contractual claims (e.g., from ski slope security or transport) are therefore processed by the company in whose (ski) area an incident occurred.

II. Basis

  1. The purchase of a valid ticket (data carrier) is a prerequisite for using the services of the KellerjochBahn.
  2. Transport takes place after an access check has been carried out.
  3. The ticket must be presented to the KellerjochBahn employees on request and handed over if necessary, so that it can be checked whether the services of the KellerjochBahn are being used correctly. If this obligation is refused, the ticket can be blocked and transport refused.

III. Fee, Price

  1. Unless otherwise agreed, the fee announced by KellerjochBahn at the time of conclusion of the contract must be paid for the purchase of the respective ticket.
  2. For a ticket, the customer is given a corresponding data storage device, for which the customer must pay a deposit fee of currently € 2.00 in the case of a reusable ticket. If the undamaged and functional reusable ticket is returned, this deposit fee will be refunded.
  3. Tickets at reduced rates can only be issued upon presentation of appropriate proof (e.g., valid photo ID).
  4. Information (in particular price information) in brochures, circulars, catalogs, advertisements, price lists, etc. is non-binding, subject to change and the prices
    announced at the time the ticket is purchased apply.

IV. VALIDITY

  1. When using the KellerjochBahn transport service, a valid ticket must always be carried
    and presented to KellerjochBahn employees upon request.
  2. If a customer is carrying a reduced-price ticket, they must provide proof of the existence
    of a reason for the reduction when checked by KellerjochBahn employees. If they do not
    provide this proof immediately or within 24 hours at the latest, the ticket will be
    confiscated without replacement. In this case, the mountain railway is also entitled to
    charge a manipulation fee.
  3. Tickets may not be transferred to third parties, resold, etc. without the prior written
    consent of KellerjochBahn.
  4. Tickets for several days are only valid on consecutive days unless a different period of
    validity is expressly specified (e.g., optional ski passes/optional subscriptions).
  5. All tickets expire at the end of the season! Points cards cannot be carried over into the
    next season.

V. MISUSE

  1. The misuse of the ticket (e.g., unauthorized passing on, use of another person’s ticket,
    use of the transport service without a ticket, disregard of the instructions necessary for
    the safe operation of the cable car system, use of a reduced ticket without fulfilling the
    requirements, etc.) leads to the immediate withdrawal of the ticket.
  2. If a customer endangers the physical integrity of third parties (e.g., other customers,
    KellerjochBahn employees, etc.) through their reckless or dangerous behavior,
    KellerjochBahn can exclude the customer – to protect third parties – from further
    transport if they continue their behavior despite a warning.
  3. In none of these cases will the remaining days of the ticket’s validity period be (pro rata)
    refunded, replaced or credited.

VI. REFUNDS

  1. If the customer does not want to use individual days of a multi-day ticket or cannot use
    them due to circumstances within his sphere of influence, these days will not be
    (proportionately) refunded, replaced or credited.
  2. If the customer is prevented from (further) using his ticket due to an accident, illness,
    etc., he is not entitled to a (proportionate) refund. However, KellerjochBahn can grant a
    proportionate refund as a gesture of goodwill for multi-day tickets upon presentation of
    a certificate from a registered doctor (confirming that the customer cannot do any more
    winter sports for the remaining period of validity) and upon return of the ticket before
    the expiry of the period of validity. However, there is no legal entitlement to this. This
    graceful refund cannot be made for day tickets and single tickets.

  3. We expressly point out that the KellerjochBahn is forced to take individual facilities out
    of service for days or hours due to a lack of snow, weather, storms, wind, technical
    defects, repairs, pre- and post-season operations.

VII. LOSS, SENSELESSNESS & DAMAGE

  1. A replacement ticket will only be issued after a ticket has been lost or damaged if the
    proof of purchase is presented. A processing fee will be charged for issuing a
    replacement ticket. The replacement ticket is valid for the remaining contract period
    after it is issued, and the lost ticket will be blocked.
  2. No replacement ticket can be issued for forgotten tickets.
  3. It is not possible to exchange, extend or postpone the validity period of a ticket.

VIII. RESPONSIBILITY & LIABILITY

  1. The KellerjochBahn is not liable for damages incurred by a customer due to the behavior
    of third parties if these third parties are not attributable to the KellerjochBahn or if they
    are not subject to its instructions.
  2. The transport contract is only concluded for the use of the open facilities and slopes
    during operating hours. Contractual claims against the KellerjochBahn therefore only
    exist for the duration of operating hours and only for open slopes.
  3. Entering, driving on or using closed facilities is prohibited and punishable.
  4. The use of the free ski area is at your own responsibility and risk. No safety or marking
    measures (such as security, controls, barriers, etc.) are carried out in the free ski area.
    Measures taken in exceptional cases are voluntary and do not constitute any obligation
    on the part of the KellerjochBahn.
  5. The maintenance of the hiking, cycling and tobogganing trails is not the responsibility of
    the KellerjochBahn. Liability for this lies with the Tourism Association of the Silver Region
    Karwendel: Münchner Straße 11, 6130 Schwaz (+43 5242 63240).

IX. OBLIGATION OF THE CONTRACTUAL PARTIES

  1. The customer is obliged to comply with the FIS rules.
  2. The FIS rules can be found on the notice board in the cash desk area and will be given to
    the customer on request.
  3. The customer must behave considerately and responsibly when practicing the sport and
    in particular must maintain a sufficient safety distance from ski slope machines, skidoos,
    snowmaking systems, etc.
  4. Instructions from employees of the KellerjochBahn and the ski slope rescue service must
    be followed, as these serve to ensure the safety of all users of the ski area and to prevent
    accidents, damage, etc.
  5. Sport is only permitted on marked ski runs and ski routes; designated protection zones
    may not be entered or used, and their use is prohibited.

  6. The operating times must be strictly observed. Use of the ski area is no longer permitted
    after the end of operations; This is particularly the case because preparation work (e.g.,
    using cable winches) is then carried out and therefore there is a risk to life.
  7. Walking and/or tobogganing on slopes is strictly prohibited. Pedestrians must only use
    the designated winter hiking trails or toboggan runs.
  8. Any contamination must be avoided.
  9. In the event of an accident, it is up to the ski slope rescue team to decide how to provide
    care and rescue measures and the ski slope rescue team is entitled to take measures
    according to their decision in the best interests of the person involved in the accident.
  10. The posted transport conditions were sent to the responsible authority in the approval
    process for the respective cable car system and correspond to the draft framework
    published by the responsible ministry. They apply (according to the legal provisions) to
    the transport of people and to their behavior in the cable car area. The customer is
    obliged to comply with these transport conditions.

X. PARKING

When using the lift:
Within the KellerjochBahn operating area (from the entrance barrier), parking is free when using the lift. The parking card must be validated at the cash desk when purchasing the ticket. Holders of the association tickets (Freizeitticket Tirol or Snow Card Tirol) can also only leave for free after using the lift.

When not using the lift:
Summer rate valid from May 1st to November 30th: € 5.00
Winter rate valid from December 1st to April 30th: € 10.00

XI. MISCELLANEOUS

The customer is responsible for complying with the official Covid or other protective measures to contain pandemics or other official regulations that the customer must comply with. If the customer does not comply with the official measures, transport cannot and must not take place. If transport is not provided for this reason, this does not constitute a claim for reimbursement.

We expressly point out that the official transport conditions must be observed when using the KellerjochBahn and that the customer should familiarize themselves with the general rules of conduct before using it.

Austrian law applies with the exception of the provisions of Austrian international private law. The applicability of the UN Convention on Contracts for the International Sale of Goods is also excluded.

XII. DATA PROTECTION

Information pursuant to Section 24 DSG 2000 on “video surveillance”. Please note that video surveillance is carried out in important areas of the company buildings, the parking area and the lifts for monitoring purposes. These video recordings are deleted immediately after the statutory period has expired. We comply with all legal requirements.

XIII. CONDITIONS FOR USE OF THE KELLERJOCHBAHN’S
W-LAN INTERNET ACCESS

  1. User agreement
  2. Use is free of charge and limited to the duration of presence in the KellerjochBahn area.
    KellerjochBahn cannot guarantee the actual availability of Internet access.
  3. Use is subject to technical possibilities. In particular, the user has no right to use the Internet Guest-LAN in any particular way or for a particular period of time.
  4. Any liability, in particular for warranty and compensation (with the exception of intent and physical injury), is hereby excluded. In particular, no liability is accepted for the content of websites accessed or files downloaded. Furthermore, no liability is accepted for any virus infection caused by using the Internet Guest-LAN. The user expressly acknowledges that the Internet Guest LAN only enables access to the Internet, but does not include any virus
    protection or firewall.
  5. Accessing pages with illegal content and distributing illegal or legally protected content are prohibited.
  6. The user is expressly prohibited from using the Internet Guest-LAN to download or otherwise distribute copyrighted content.
  7. Any misuse of the Internet Guest-LAN, in particular any use that may have adverse legal consequences for third parties or the KellerjochBahn, is prohibited.
  8. If the KellerjochBahn is exposed to claims from third parties for any reason as a result of the user’s use of the Internet Guest-LAN, the user is obliged to indemnify and hold the KellerjochBahn harmless in this regard.
  9. In the event of a breach of the terms of use or if a breach is suspected, the use of the Internet Guest-LAN can be blocked at any time without giving reasons. Liability for data loss is expressly excluded.

XIV. LIABILITY DISCLAIMER CLAUS

The ski area operator excludes any liability unless/except the compensable damage occurred as a result of intentional or grossly negligent, unlawful behavior attributable to him.
